ARTICLE 2 — Applicability
2.1 These terms and conditions apply to every offer made by Jenna Arts through the webshop and to every distance contract concluded between Jenna Arts and a consumer (a natural person acting for purposes outside their trade, business, craft or profession).
2.2 Contracts with professional clients (B2B), such as illustration commissions and licences, are governed by separate terms and conditions. These webshop terms do not apply to them.
2.3 Before the contract is concluded, the text of these terms and conditions is made available on the website, so that the consumer can save or print it.
ARTICLE 3 — The offer
3.1 The offer contains a sufficiently detailed description of the products offered. Images are a faithful representation; minor differences in colour or appearance (for example due to screen settings or the printing process) are possible and do not constitute a defect.
3.2 Any offer may be changed or withdrawn. Products delivered from stock are available while stocks last. Obvious mistakes or errors in the offer are not binding on Jenna Arts.
ARTICLE 4 — The contract
4.1 The contract is concluded when the consumer places the order, accepts these terms and conditions and Jenna Arts confirms the order electronically.
4.2 Jenna Arts confirms receipt of the order by email without delay. As long as receipt has not been confirmed, the consumer may cancel the contract.
ARTICLE 5 — Price and payment
5.1 All prices are in euros and include VAT. Any delivery or shipping costs are stated separately before the order is completed.
5.2 Payment is made using the payment methods offered in the webshop (Wix Payments). The order is processed once payment has been received.
5.3 Jenna Arts does not store full payment card details; payment is handled by a secure payment service provider.
ARTICLE 6 — Delivery and performance
6.1 Jenna Arts delivers only within Belgium and the European Union. Orders with a delivery address outside the EU cannot be processed.
6.2 Prints are printed to order and shipped directly to the consumer by a specialised printing partner of Jenna Arts. Jenna Arts remains the seller and the point of contact for the consumer.
6.3 Jenna Arts delivers within the period stated on the website, which for prints includes the time needed for printing, and in any event no later than 30 days after the order, unless another period has been agreed.
6.4 If a product is not delivered, or not delivered on time, the consumer may set an additional reasonable period. If delivery still does not take place within that period, the consumer is entitled to terminate the contract and the amount paid will be refunded without delay.
6.5 The risk of damage or loss passes to the consumer when they (or a third party designated by them) take physical possession of the products.
ARTICLE 7 — Right of withdrawal
7.1 The consumer has the right to withdraw from the contract within 14 calendar days without giving any reason. This period starts on the day after the consumer (or a third party designated by them) takes physical possession of the product.
7.2 To exercise the right of withdrawal, the consumer informs Jenna Arts within this period by means of an unequivocal statement sent by email to hello@jenna-arts.com, or by using the model withdrawal form in the annex. Use of the model form is not mandatory.
7.3 After giving notice, the consumer returns the product without undue delay and in any event within 14 calendar days. The direct cost of returning the product is borne by Jenna Arts; the consumer contacts hello@jenna-arts.com in advance to arrange the return.
7.4 During the withdrawal period, the consumer handles the product and its packaging with care, and is liable for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the product.
ARTICLE 8 — Exclusion of the right of withdrawal
8.1 The right of withdrawal does not apply to products made to the consumer’s specifications or clearly personalised for a specific person. Commissioned illustrations and other custom work always fall under this exception.
8.2 For a custom commission, what will be made and at what price is agreed in advance, at least by email. The consumer expressly acknowledges that they have no right of withdrawal for such work once Jenna Arts has started performing it.
8.3 Standard products from the webshop, such as non-personalised prints and cards, are covered by the right of withdrawal as described in article 7.
ARTICLE 9 — Obligations in case of withdrawal
9.1 Following withdrawal, Jenna Arts refunds all payments received, including the standard delivery costs, within 14 calendar days of the day on which the consumer gave notice of withdrawal.
9.2 If the consumer chose a more expensive delivery method than the cheapest standard delivery offered, the additional cost of that method will not be refunded.
9.3 Jenna Arts may withhold the refund until it has received the products back, or until the consumer has supplied evidence of having sent them back, whichever is earlier.
9.4 The refund is made using the same means of payment that the consumer used, unless agreed otherwise. No fees are charged for the refund.
ARTICLE 10 — Legal guarantee and conformity
10.1 The consumer benefits from the 2-year legal guarantee of conformity under Belgian law. Jenna Arts guarantees that the products conform to the contract, to the stated specifications and to the reasonable expectations of the consumer.
10.2 In the event of a lack of conformity, the consumer is entitled to repair or replacement and, if that is not possible or appropriate, to an appropriate price reduction or termination of the contract. The consumer reports the defect within a reasonable time after discovering it.
10.3 If a product arrives damaged or with a printing error, the consumer reports this as soon as possible to hello@jenna-arts.com, preferably with a photo. Jenna Arts will then provide a new copy free of charge or, if that is not possible, a refund.
ARTICLE 11 — Complaints
11.1 Complaints about the performance of the contract can be submitted to hello@jenna-arts.com. Jenna Arts aims to respond to complaints within 7 working days. If a complaint requires more time, the consumer will receive an acknowledgement of receipt within that period, with an indication of when a full response can be expected.
ARTICLE 12 — Applicable law and disputes
12.1 This contract is governed by Belgian law.
12.2 If the parties cannot resolve a dispute between themselves, the consumer may contact the Belgian Consumer Mediation Service (Consumentenombudsdienst) free of charge: North Gate II, Boulevard du Roi Albert II 8 box 1, 1000 Brussels — contact@consumentenombudsdienst.be — www.consumentenombudsdienst.be.
12.3 The consumer may also bring the matter before the competent court.
ARTICLE 13 — Intellectual property
13.1 All illustrations, designs, images and texts in the webshop and on the products are protected by copyright and remain the property of Jenna Arts. Purchasing a product does not give the consumer any intellectual property rights.
13.2 It is not permitted to copy, reproduce or commercially use the works or images, or to use them to train automated or AI systems, without prior written permission.
ARTICLE 14 — Personal data
14.1 Jenna Arts processes personal data in accordance with the privacy policy, which is available on the website.
ARTICLE 15 — Changes to these terms
15.1 Jenna Arts may amend these terms and conditions. Each contract is governed by the terms that applied at the time the order was placed.
